ASYLUM

An asylum is a form of protection granted to foreign nationals who have been persecuted in their home country or have a well-founded fear of persecution if they return to their home country. To be protected under asylum law, the applicant must demonstrate that the persecution occurred due to political opinion, religious belief, membership in a particular social group, race, or nationality. REPRESENTACION ANTE LOS TRIBUNALES DE INMIGRACION

Immigrants and non-citizens may be referred to immigration courts for different reasons. Facing removal proceedings (commonly known as deportation) from the United States is challenging and requires legal representation. Attorney John R. FAMILY PETITIONS

Some U.S. citizens and lawful permanent residents can petition for their close relatives under U.S. immigration laws. The applicant can undertake the family petition process within the United States or at U.S. embassies in other countries. At John R. De la Vega, P.A., we have efficiently and swiftly processed family petitions for individuals from various countries. We are always prepared to guide the latest immigration changes in the United States.

REPRESENTATION IN BOND PROCEEDINGS

John R. De la Vega, P.A., represents clients in bond hearings who have been detained by Immigration and Customs Enforcement (ICE). Some immigrants in these centers may qualify for release on bond and continue their immigration processes while out of detention. Our firm has successfully represented many detained clients and has secured the release of immigrants accused of various crimes, including domestic violence.

FIANCEE VISAS (K-1 VISA)

The K-1 visa allows a U.S. citizen to petition their fiancée in another country on the condition that they must marry within 90 days after the fiancée arrives in the United States. It is the responsibility of the U.S. citizen to file the I-129F visa with all the required evidence for USCIS. Our office has the tools and knowledge to help you efficiently process your K-1 fiancée visa application.

IMMIGRATION WAIVERS

If you are found ineligible to be admitted to the United States as an immigrant and wish to obtain an immigrant visa, adjustment of status, certain non-immigrant statuses, or other immigration benefits, you must present a waiver. This waiver requires you to present evidence to USCIS explaining why you deserve this waiver to live in the United States. At the office of attorney John R. PAROLE

Parole allows a person who would typically not be allowed into the United States to be temporarily admitted for a specific period. The Immigration and Nationality Act (INA) gives the Secretary of Homeland Security the authority to use discretion in granting parole to foreign nationals who request temporary admission for humanitarian reasons or significant public benefit.

CITIZENSHIPS

"Naturalization" is the term used in immigration law to describe the process of becoming a U.S. citizen. The requirements to become a citizen are extensive, and the parameters are stringent. Our firm assists clients in the naturalization process by submitting the citizenship application and representing clients during the interview with an immigration officer.

STUDENT VISAS

The F-1 (Academic Student) visa category allows you to enter the United States full-time at an institute, university, seminary, conservatory, academic high school, or other institution or language training program. You must be enrolled in a program or curriculum that leads to a degree, diploma, or certificate, and the U.S. government must authorize your school to accept international students. If you are already in the United States with a different type of visa, you can apply for an F-1 visa by changing your current status.

EB-3 VISA - THIRD PREFERENCE IMMIGRANT WORKERS

The EB-3 visa is intended for foreign workers seeking permanent employment in the United States in occupations that require lower-level labor skills, unskilled labor skills, or non-specialized services. This visa falls under the employment-based immigration category.

EB-1 VISA - FIRST PREFERENCE IMMIGRANT WORKERS

The EB-1 visa is intended for exceptional immigrant workers, outstanding professors and researchers, and multinational executives or managers. This visa is part of the employment-based immigration category and is reserved for individuals with extraordinary abilities in their respective fields.

EB-2 VISA - SECOND PREFERENCE IMMIGRANT WORKERS

The EB-2 visa is intended for immigrant workers with advanced skills or degrees seeking permanent employment in the United States. This visa is part of the employment-based immigration category and is specifically for individuals with exceptional skills in their respective fields.

O-1 VISA - PERSONS WITH EXTRAORDINARY ABILITY OR ACHIEVEMENTS

The O-1 visa is designed for individuals with extraordinary abilities or achievements in science, arts, education, business, or athletics who wish to work temporarily in the United States. This visa falls under the non-immigrant temporary worker category and is reserved for individuals with exceptional talent in their respective fields.

P-1A VISA - INTERNATIONALLY RECOGNIZED ATHLETE

The P-1A visa is intended for internationally recognized athletes who want to compete in specific sporting events in the United States temporarily. This visa is categorized as a non-immigrant temporary worker visa, specifically for high-level athletes who have achieved significant recognition and success in their sports.

E-1 AND E-2 VISAS - TREATY TRADERS AND INVESTORS

The E-1 and E-2 visas are intended to promote trade and investment between the United States and specific countries that have trade treaties with the United States. These visas are classified as non-immigrant temporary worker visas and are available to entrepreneurs, traders, and investors who want to engage in business or investments in the United States.

Born in Caracas, Venezuela, attorney John R. De la Vega, Esq. graduated from Florida International University (FIU) with a Bachelor’s degree in Criminal Justice and a Juris Doctor degree.

Attorney De la Vega has devoted his career to advocating for immigrants’ rights in the United States.

In addition to his work as an immigration attorney, Mr. De la Vega is also a United States Armed Forces veteran, where he participated in several missions supporting Operation Iraqi Freedom (OIF).

Attorney De la Vega is fluent in Spanish and English and has represented numerous immigrants in local immigration courts, before the USCIS, and at various U.S. embassies worldwide.
